| Introduction | This talk presents practical applications of generative AI for brand protection, centered on Markcloud’s flagship service, Markview. When a user inputs a candidate mark, Markview assesses registrability by analyzing distinctiveness, similarity, and goods/services classes. It also monitors the actual use of registered marks and surfaces potential non-use. To detect unauthorized preemptive filings abroad, the system tracks and analyzes foreign trademark-filing data. By leveraging generative AI, it models patterns across tens of millions of trademark records and derives criteria aligned with examination practice, enabling more precise analysis and similarity assessment than conventional rule-based approaches. |

| Introduction | As AI technology advances, patent filings involving software, algorithms, and data processing have rapidly increased, but many face §101 rejections as “abstract ideas.” Following the Alice v. CLS Bank decision, the USPTO’s 2019 guidance evaluates whether an invention involves an abstract idea and whether it is integrated into a practical application. AI inventions limited to mathematical or data-processing concepts are often rejected, while those applied in specific technical contexts—such as autonomous driving, semiconductor fabrication, or medical imaging—are more likely to be deemed patent-eligible. The USPTO’s 2024 AI update (Examples 47–49) clarified that AI-related inventions showing concrete technological improvements can satisfy §101, and its 2025 AI Strategy further emphasized innovation, responsible AI use, and international cooperation. In this evolving environment, applicants must adopt clear, technically grounded, and strategic approaches to overcome §101 challenges and secure patent protection for AI inventions. |
